RE: The tariff classification of paper-based self-adhesive label materials, from Luxembourg.

Dear Mr. Campbell:

In your letter dated July 16, 1999, you requested a tariff classification ruling for two products, designated Fasson LaserCopyJet/LR2/44LF, product code OA0105, and Fasson ZigZag/S2010/AT 70 NI, product code LA0276. Samples were submitted, along with product data sheets and a Process Flow chart for them, as well as a 1999 Avery Dennison Company Profile. These will be retained for reference.

You describe these articles as follows:

A top layer consisting of unprinted, bleached, uncoated or coated printable label paper from Chapter 48. The bleached paper is not printed or colored.

A pressure-sensitive adhesive at a coat weight of approximately 25 grams per square meter which is permanently adhered to the top layer.

A bottom protective release liner that consists of a base paper coated with a silicone release coating.

Both articles will be imported in rolls 80” wide by 10,000 to 15,000 feet in length. They will be made, in the U.S., after importation, into labels which are classifiable in heading 4821 of the Harmonized System. “Zigzag – AT70” is designed for use in high speed laser printers and impact printers, has a rated shelf life of two years, and employs a permanent acrylic based adhesive.

“LaserCopyJet/44LF” is designed for use in sheet-fed laser printers, copiers and monochrome ink jet printers, has a rated shelf life of one year, and employs a removable emulsion acrylic adhesive.

The applicable subheading for these products will be 4811.21.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for: Gummed or adhesive paper and paperboard: Pressure-sensitive. The rate of duty will be 2.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
