RE: The tariff classification of decorative porcelain articles from China.

Dear Ms. Smith:

In your letter dated July 2, 1999, you requested a tariff classification ruling. Samples are being returned as requested.

The samples submitted consist of the following decorative porcelain articles:
a) stock number 93095, which consists of the ivory-glazed upper body portion of the Madonna measuring approximately 7 inches in height and holding a flower in the palm of her hands.
b) stock number 93089, which consists of an underglazed cross that measures about 7 ¾ inches high and possesses a top circular metal loop for hanging purposes. It is stated that one style will feature a girl, while the other style will have a boy, both affixed to the front of the cross with a bird.
c) stock number 93271, which consists of a jade porcelain dinner bell, measuring about 5 ½ inches in height, that is decorated with slightly raised depictions of snowman, tree and celestial-like motifs and a top snowman-like figure holding sign with wording “Ho Ho Ho.” It also possesses a dangling article within its interior.

The applicable subheading for these decorative porcelain articles will be 6913.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other ornamental ceramic articles of porcelain, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
