RE: The tariff classification of transmission components from various countries.

Dear Mr. Walsh:

In your letter dated July 9, 1999 you requested a tariff classification ruling on behalf of Ford Motor Company.

The items in question are identified as a transmission main control assembly, service part number F5TZ 7A100C, a transmission valve body lower, service part number 95GT 7A101 AK, and a transmission spool valve, service part number F6CZ 7G398 AA. Descriptive literature, technical drawings and a sample were submitted.

The transmission main control assembly is a component of an automatic transmission. The assembly is comprised of an aluminum casting that is precisely machined with holes and passages designed to accommodate a series of valve components, such as ball check, poppet and spool mechanisms. The valve mechanisms, when assembled with the casting, form a complete valve that will control a range of variables for the flow of hydraulic fluid within the transmission assembly. The control assembly is located within the transmission oil pan and serves as the control center for the automatic transmission.

The item in question identified as the transmission valve body is the machined aluminum casting that serves as the body for the valve mechanisms. The item identified as a spool valve is not complete valve, but rather part of valve mechanism used to form a spool valve within the transmission main control assembly.

The applicable subheading for the transmission main control assembly will be 8481.20.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other valves for oleohydraulic transmissions. The general rate of duty will be 2 percent ad valorem.

The applicable subheading for the transmission valve body lower will be 8481.90.9020, HTSUS, which provides for other valves for valve bodies, as parts of valves of subheading 8481.20. The general rate of duty will be free.

The applicable subheading for the spool valve will be 8481.90.9040, HTSUS, which provides for other parts of valves of subheading 8481.20. The general rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
