RE: The tariff classification of table lamps from China.

Dear Mr. Taddeo:

In your letter dated June 30, 1999, on behalf of Verilux, Inc., you requested a tariff classification ruling.

The subject merchandise is a composite article consisting of a plastic table lamp with hemp shade (item number CFB23VLX) that measures approximately 22 inches in height by 14 inches in width and contains, around its bottom portion, a digital alarm clock with backup alarm chime. It also possesses light and sound controls to simulate sunset and sunrise features for ease in sleeping and waking. It has been determined that the essential character of this composite article is not imparted by the digital clock and, therefore, not classifiable under chapter 91 of the Harmonized Tariff Schedules of the United States (HTS).

The applicable subheading for this table lamp will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings, other. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
