RE: The tariff classification of water globes from China.

Dear Mr. Keegan:

In your letter dated June 24, 1999, on behalf of your client Russ Berrie and Company, Inc., you requested a tariff classification ruling.

You have submitted two samples of water globes.

Item #16792 is identified as a “A Tweet Touch of Magic”. It is a 100mm glass snow globe with a tempo printed base. It measures approximately 8” x 5” x 7-1/2” (high). The top of the globe features the head of a snowman in a top hat and muffler. Next to the snowman’s head is a bird-like figure. The figure is wearing a red cap with a Christmas candy cane type rim. It is holding on to the snowman’s muffler. At the base, to the left of the globe is a red bird-like figure, wearing a muffler, facing the globe. Inside the globe, is a Christmas motif that is made up of a miniature decorated Christmas tree on snow covered ground.

Item #16809 is identified as “A Tweet Holiday Surprise”. It is an 80mm glass snow globe with a printed tempo base. This globe measures approximately 5-3/4” x 5” x 5” (high). The top of the globe features a red bird-like figure wearing earmuffs. On the base is another brown bird-like figure wearing a Christmas type red and green cap. Within the globe is a Christmas motif that is made up of a miniature snowman wearing a top hat and muffler. The snowman holds a miniature decorated Christmas tree in one hand.

The samples are returned as you requested.

The applicable subheading for both of the above mentioned samples will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides forÂarticles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
