RE: The tariff classification of baby products from The Netherlands.

Dear Ms. Van Den Berg:

In your letter dated June 22, 1999, you requested a tariff classification ruling.

You have submitted catalog pages depicting five samples of baby products.

Item #6212 is a plastic box filled with swabs and balls. The swabs and balls are assumed to be of cotton. This plastic box is not specifically designed to hold these items. In our opinion other items can also be stored in the plastic box. The plastic box, swabs and balls are not a set for tariff purposes. The box and the cotton products will be classified separately.

Item #3541 is a plastic (250cc) feeding bottle. The bottle has a plastic cap, a white plastic screw cap, a white plastic ring, a white/gray plastic little plate and a silicone nipple.

Item #3542 is a plastic (125cc) feeding bottle. The bottle has a plastic cap, a white plastic screw cap, a white plastic ring, a white/gray plastic little plate and a silicone nipple.

Item #6543 is a glass (250cc) feeding bottle. The bottle has a plastic cap, a white plastic screw cap, a white plastic ring, a white/gray plastic little plate and a silicone nipple.

Item #6545 is a thermos bottle. This bottle consists of a plastic outside cover with a plastic cap. The inside bottle is made of glass, with a white plastic screw cap, a white plastic ring, a white/gray little plate and a silicone nipple.

We cannot rule on items #6543 and #6545 at this time. Please supply samples of each item and indicate the unit value at which the item is sold by the foreign firm to the American importer. For the thermos bottle, please submit a breakdown indicating the value of the glass component and the value of the plastic component.

The applicable subheading for items #3541, #3542 and the plastic box in item #6212, will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides forÂother household articlesÂof plastics: other, other. The rate of duty will be 3.4 percent ad valorem.

The applicable subheading for the cotton swabs and cotton balls in item #6212, will be 5601.21.0090, HTS, which provides for waddings of textile materials and articles thereof;Âwadding; other articles of wadding; of cotton, other. The rate of duty will be 5.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
