RE: The tariff classification of plastic baby products from the Netherlands.

Dear Ms. Van Den Berg:

In your letter dated June 22, 1999, you requested a tariff classification ruling.

You have submitted catalog pages depicting three samples of baby products made of plastic.

Item #3250 consists of a babyÂ’s bottle and nipple cleaning brushes with plastic holders. The holders are made of molded plastic.

Item #3255 is a non spilling nozzle. This article is a leakproof lip designed to screw on baby bottles. It is made of molded plastic. It is not a nursing nipple.

Item #3240 is a pacifier holder. It is made of molded plastic with a silk screen design.

We cannot rule on the classification of item #3240 at this time. In order to classify this item we will need a sample and a breakdown of the component materials by weight and value.

The applicable subheading for item #3255, the non spilling plastic nozzle will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides forÂother household articles and toilet articles, of plastics: other, other. The rate of duty will be 3.4 percent ad valorem.

The applicable subheading for item #3250, bottle and nipple cleaning brushes, will be 9603.90.8050, HTS, which provides for other brushes. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
