RE: The tariff classification of a child’s T-Shirt and an infant’s Creeper from China.

Dear Mr. Chan:

In your letter dated June 23, 1999, you requested a tariff classification ruling.

The submitted samples are described as follows:

Style #6118 – A child’s unisex white T-Shirt. The garment is constructed of 100% cotton jersey knit fabric and features a scoop rib knit neckline, short sleeves with rib knit cuffs and a hemmed bottom.

Style # 6102 – An infant’s Creeper. The garment is constructed of 100% cotton jersey knit fabric and features a scoop rib knit neckline, short sleeves, and a snap crotch.

In a telephone conversation with a member of your staff, it was stated that the T-shirt, Style #6118 will be imported in sizes 2T, 3T, and 4T and the Creeper, Style #6102, will be imported in infants’ sizes 12, 18 and 24 months.

We are returning your samples as requested.

The applicable subheading for the T-Shirt, Style #6118, will be 6109.10.0045, Harmonized Tariff Schedule of the United States (HTSUS), which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted, of cotton, women’s or girls’, other, T-shirts, girls’. The duty rate will be 18.8% ad valorem.

The T-shirt falls within textile category designation 339. Based upon textile trade agreements, products of China are presently subject to quota restraints and visa requirements.

The applicable subheading for the Creeper, Style #6102, will be 6111.20.6010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted, of cotton, T-shirts, singlets and similar garments, except those imported as parts of sets. The duty rate will be 8.4% ad valorem.

The Creeper falls within textile category designation 239. Based upon textile trade agreements, products of China are presently subject to quota restraints and visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
