RE: The tariff classification of an electric window opener from Taiwan and Hong Kong

Dear Mr. Anderson:

In your letter dated June 22, 1999, on behalf of Andersen Corporation, you requested a tariff classification ruling.

The sample you provided is item #AW 1853302, the Andersen Electric Window Opener Kit. The kit includes an electric motor power operator, a hand-held command center, a power supply unit and a rain sensor unit. The kit is used with Andersen Awning and roof windows.

The power operator is a DC electric motor with a maximum output of 40 Watts. The power supply converts AC current to DC current for the motor. The command center is a small keypad, which commands the motor to open and close the window. The rain sensor unit is a sensor strip that detects rain and closes the window automatically.

The applicable subheading for the window opener will be 8501.31.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for electric motors, other DC motors, of an output not exceeding 750 W, motors, exceeding 37.5 W but not exceeding 74.6 W. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
