RE: The tariff classification of blank video cassettes from Mexico.

Dear Mr. Wortman:

In your letter dated June 15, 1999, you requested, on behalf of your client Technicolor, a tariff classification ruling.

You have submitted a sample (Model T-30/160) which is a VHS blank prepared 1/2 inch tape which you state is imported into the United States for purposes of duplication. You stated that the length of video tape in each cassette will vary depending upon the length of the “specific feature” your client intends to record.

The applicable heading for the Model T-30/160 will be 8523.13.0040, HTS, which provides for Prepared unrecorded media for sound recording or similar recording of other phenomena, other than products of chapter 37: Of a width exceeding 6.5 mm: Suitable for video recording: In cassettes. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
