RE: The tariff classification of  Silly String imported from Spain.

Dear Mr. Parisi:

In your letter dated June 11, 1999, you requested a tariff classification ruling in behalf of your client, Laiko International Inc., for an item called Silly String.

The item consists of a pressurized container which projects a nonflammable substance called silly string. Shaking the can before use and depressing the red nozzle located on top of the canister enables the user to deploy a stream of string through the air. Releasing the nozzle stops the spray.

The applicable subheading for the Silly String will be 9505.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive, carnival or other entertainment articles.......:,Other: Confetti, paper spirals or streamers, party favors....... The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
