RE: The tariff classification of ladies’ garments from the Dominican Republic.

Dear Mr. Van Sise:

In your letter dated June 9, 1999, you requested a classification ruling on behalf of Crown Foundations, Inc.

Three samples were provided for review. Style 301 is a foundation garment constructed of three panels of 75% nylon 25% spandex knitted material. The front of the garment is constructed of one panel of material which extends to the mid-thigh and has strapless fiber-filled underwire cups. The back of the garment is made of two panels sewn together up the middle. At the top of the garment back is a fabric covered elasticized band, on the inside of which is sewn another elastic band with rubberized stitching which prevents the garment from pulling down on the wearer. The garment features a sewn-in panty with a three hook and eye closure at the crotch and a hemmed bottom. Style 302 is the larger sized version of style 301.

Style 440 is a foundation garment constructed of 75% nylon 25% spandex knitted material, the garment extends to the thigh. The garment features adjustable elasticized shoulder straps, a soft cup brassiere top, a powernet panel sewn down the center of the garment front has two-ply construction below the bust, two side panels, two powernet panels extend vertically down the garment back, and a one inch wide elasticized bottom band with inner rubberized stitching prevents the garment from riding up the wearer’s legs.

The applicable subheading for styles 301, 302 and 440 will be 6212.90.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for Brassieres, girdles, corsets, braces suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: other . . . of man-made fibers or man-made fibers and rubber or plastics. The duty rate will be 6.8 percent ad valorem.

All garments falls within textile category designation 659. Based upon international textile trade agreements products of the Dominican Republic are subject to the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
