RE: The tariff classification of a Girls Knit Cotton/Polyester Hooded Top from Mexico

Dear Mr. Armani:

In your letter dated June 4, 1999, you requested a tariff classification ruling.

The sample submitted, Order Number UB2050, is a Girls Knit 57% Cotton/43% Polyester Hooded Sweatshirt style top. This garment features a hood, long sleeves, two front pockets, an open hemmed bottom, and a full front zippered opening. The Disney logo Pooh 100 Acre Collection is printed on the label located at the nape of the neck. The words Tigger Sport are embroidered on the left front chest area. An embroidered tiger applique is positioned to appear as if it is running through the pockets across the front of the garment. You state the sweatshirt will be imported in Girls sizes 2-4T, 4-6X, and 7-14. The sample will be returned to you as requested.

The applicable subheading for the Girls Cotton/Polyester Knit Sweatshirt style top will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of Cotton: Other: Other: Other: Womens or girls. The rate of duty will be 18.6%.

The Girls Knit Cotton/Polyester Hooded Sweatshirt style Top falls within textile category designation 339. Based upon international textile trade agreements, products of Mexico are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent negotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U. S. Customs Service Textile Status Report, an internal issuance of the U. S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
