RE: The tariff classification of children’s fleece sleeping sack from China.

Dear Ms. Balog:

In your letter dated June 1, 1999, on behalf of your client Hollander Home Fashions Corp., you requested a tariff classification ruling.

The submitted sample, designated as a “Snug Sack®”, is a 100% polyester fleece slumber bag. Measuring 50" X 30", this product is manufactured from knit pile fabric and has been designed in the form of a lobster. The bag features a hood and a front zipper closure. This bag is intended for children aged 3 to 8 and will be used as a covering for the child in a indoor environment while he or she naps, watches television or performs other indoor pursuits. The bag has not been stuffed and relies for warmth on a single layer of knit fleece fabric.

The applicable subheading for the “snug sack” will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns, other, other, other, other, other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
