RE: The tariff classification of women’s wearing apparel from China, Hong Kong, Indonesia, Singapore and Taiwan

Dear Ms. Greener:

In your letter dated April 9, 1999, you requested a classification ruling. This letter replaces NY ruling E80403, dated May 14, 1999. In reviewing that letter clerical errors in the Harmonized Tariff Schedule description were identified. Those clerical errors have been corrected in the text below.

Style 017-0278 is a woman’s jumper constructed from 100 percent rayon woven fabric. The jumper features oversized armholes, a round neckline, a partial front opening secured by three buttons, side seam pockets, and a self fabric tie belt in the back. This garment will also be imported in petite and tall sizes under style numbers 017-0279 and 017-0280.

Style 017-1590 is a woman’s jumper constructed from 100 percent cotton corduroy woven fabric. The jumper features a V-neckline, partial openings under each arm secured by three buttons, two pockets at the waist and side vents. This garment will also be imported in petite and tall sizes under style numbers 017-2054 and 017-2429.

Style 017-5741 is a woman’s jumper constructed from 100 percent cotton knit fabric. The jumper features oversized armholes, a V-neckline, a partial front opening secured by three buttons, side seam pockets and an empire waist. This garment will also be imported in petite and tall sizes under style numbers 017-5742 and 017-5745.

Style 017-2475 is a woman’s jumper constructed from 60 percent linen and 40 percent rayon woven fabric. The jumper features oversized armholes, a round neckline, a back vent and side seam pockets. This garment will also be imported in petite and tall sizes under style numbers 017-2476 and 017-2477.

The applicable subheading for style 017-0278 will be 6211.43.0066, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: jumpers: other. The duty rate will be 16.5 percent ad valorem.

The applicable subheading for style 017-1590 will be 6211.42.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: jumpers. The duty rate will be 8.4 percent ad valorem.

The applicable subheading for style 017-5741 will be 6114.20.0015, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of cotton: jumpers. The duty rate will be 11.2 percent ad valorem.

The applicable subheading for style 017-2475 will be 6211.49.9060, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of other textile materials: other: jumpers. The duty rate will be 7.6 percent ad valorem.

Style 017-0278 falls within textile category designation 659; styles 017-1590 and 017-5741 fall within textile category designation 359 and style 017-2475 falls within textile category 859.

Based upon international textile trade agreements products of China, Hong Kong, Indonesia and Taiwan are subject to quota restraints and a visa requirement. Products of Singapore are currently not subject to quota restraints but are subject to a visa requirement. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
