RE: The tariff classification of a flexible screwdriver and a tube bender from Taiwan.

Dear Ms. Denny:

In your letter dated May 25,1999, on behalf of Alltrade, you requested a tariff classification ruling.

Two samples were submitted with your request. The first item, part number 648595, is identified as a carburetor adjusting tool. The item includes a tool holder with a plastic handle, a 6-inch long flexible shaft, and two double end bits. The bits are a combination slotted screwdriver and 2.5mm hex bit and a combination 5mm nut driver and a double-d bit. Your packaging indicates the item is used to adjust carburetors where the idle and mixture adjusting screws are difficult to reach with a standard screwdriver

The second item, part number 648485, is identified as a deluxe tube bender. This item is used to bend copper, steel or aluminum tubing without crimping the metal. The item has plier-type handles, steel roller/guides and two interchangeable discs to accommodate tubing of various diameters. The user places the tubing between the rollers, grasps the tool by the handle and bends the tubing to the desired shape.

The applicable subheading for part number 648595, the carburetor adjusting tool, will be 8205.40.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for screwdrivers. The rate of duty will be 6.2 percent ad valorem.

The applicable subheading for part number 648485, the tube bender, will be 8205.59.1000, HTS, which provides for handtools not elsewhere specified or included; pipe tools. The rate of duty will be 7.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
