RE: The tariff classification of novelty coin purses, a cosmetic purse and hair claw clips from China.

Dear Ms. Malcangi:

In your letter dated May 26, 1999, on behalf of Buy Rite Costume Jewelry, you requested a classification ruling for novelty coin purses, a cosmetic purse and hair claw clips.

You have submitted three samples, identified as items 1, 2 and 3. Items 1 and 2 are novelty coin purses designed in the shape of mini packs manufactured with an exterior surface of 100 percent cotton. Both items feature a split metal key ring attached to the zipper pull. Item 3 is a cosmetic purse manufactured of 100 percent nylon woven fabric. Inside the purse is ten plastic hair claw clips. All three items are secured by means of top zippered closures.

The applicable subheading for the novelty coin purses of 100 percent cotton will be 4202.32.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.8 percent ad valorem.

The applicable subheading for the cosmetic purse of 100 percent nylon will be 4202.92.3031, HTS, which provides for travel,, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 18.8 percent ad valorem.

The applicable subheading for the plastic hair claw clips will be 9615.11.4000, HTS, which provides for combs, hair-slides and the like: of hard rubber or plastics: other, not set with imitation pearls or imitation gemstones. The duty rate will be 5.3 percent ad valorem.

The coin purses fall within textile category designation 369. The cosmetic purse falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
