RE: The tariff classification of various bath linens from China.

Dear Ms. Johnson:

In your letter dated July 8, 1999 you requested a classification ruling on behalf of AG Industries.

You submitted samples of various bath linens. SLK-01 is a circular facial pad that measures 9.5 centimeters in diameter. It is comprised of a piece of foam which is covered with textile. The front portion of the outer shell is stated to be made from 100 percent silk woven fabric and the back is made from 100 percent polyester knit fabric. A two centimeter wide ribbon strap is sewn across the back portion of the pad.

Style no. SLK-02 is a washcloth. It is comprised of two fabrics sewn that have been sewn together along the edges. The front portion of the washcloth is stated to be made from 100 percent silk and the back 100 percent cotton woven fabric. The washcloth measures approximately 24 centimeters square. One corner of the cloth features two embroidered flowers.

Style no. SLK-03 is a towel comprised of two fabrics that have been sewn together along the edges. The front side is stated to be made from 100 percent silk woven fabric. The back is stated to be made from 100 percent cotton terry fabric. The rectangular towel measures approximately 22 x 83 centimeters.

Style no. SLK-04 is a bath mitt. One side is stated to be made from 100 percent silk woven fabric and the other side 100 percent cotton terry fabric. The silk side is backed with a thin layer of foam. There is an opening on the bottom of the mitt used to accommodate the insertion of a hand. The opening of the mitt is trimmed with a thin strip of woven silk fabric.

Style no. SLK-06 is a bath sponge. The sponge is comprised of a solid piece of polyurethane foam that is covered entirely with a 100 percent silk knit fabric.

The applicable subheading for all of the bath linens will be 6302.99.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: of other textile materials: containing 85 percent or more by weight of silk or silk waste. The rate of duty will be 4 percent ad valorem.

Presently, subheading 6302.99.1000, HTS, is not assigned a textile category designation and items classified therein are not subject to quota or visa requirements.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
