RE: The tariff classification of plastic/metal tower internals from Germany

Dear Ms. Peals:

In your letter dated May 11, 1999 you requested a tariff classification ruling.

You indicate that all of the following items, described in the submitted brochure as Tower Internals, will used in packed columns for industrial gas cleaning. The principal application will be in waste gas scrubbers. (This request covers items of metal or plastic only. The Tower Internals of ceramic are the subject of a separate ruling request). The items include:

Droplet Separators - installed at the top of a column to prevent liquid droplets in the outgoing gas stream from exiting the packed column. They may be mesh type (demisters) or chevron type.

Liquid Distributors - insure even distribution of liquids in the packed bed. They include pipe and trough distributors.

Bed Limiters - installed at the top of a packed bed to prevent movement of the random packings.

Liquid Collecting Trays - located below the column’s support plate and utilize chevron type structures to collect down coming liquid which is then transported through a series of troughs to a main collecting trough. Redistributors - allow the redistribution of liquid throughout the entire bed.

Support Plates - support the weight of the packed bed, liquid load and potential solids buildup.

Mist Eliminator - allows vapor to flow through the system while the liquid is entrained in the mesh pad.

The applicable subheading for the above Tower Internals of metal or plastic will be 8421.99.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for other parts of filtering or purifying machinery and apparatus, for liquids or gases. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
