RE: The tariff classification of two handbags and a travel bag from Hong Kong

Dear Ms. Sergo:

In your letter dated May 4, 1999, you requested a tariff classification ruling. Three samples were submitted for our examination. For reference purposes, the samples have been numbered one through three.

Sample no. 1, designated Proto # JDA-55 "TIIA," is a ladies handbag with an outer surface of polyvinyl chloride. It measures approximately 9 x 8 x 3 inches with two carrying handles and a snap-top closure. It also features a zipper-secured interior compartment and a glittery exterior.

Sample no. 2, designated Proto # JDA-47 "Teddy Bag," is a handbag with an outer surface of 70% acrylic and 30% polyester, manmade fibers. It measures approximately 10 x 9 x 2 inches. The bag features one zippered interior compartment, a zippered-top closure, vinyl trim and handles.

Sample no. 3, Proto # JDA-60, "Jake Waist Pack," is a belt pouch with an outer surface of 100% nylon, manmade fibers. The belt pouch measures approximately9 x 7 inches with a zippered closure and a strap designed to fasten around the waist of the user. Your samples are herein returned.

The applicable subheading for sample no. 1 will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for: Handbags; whether or not with shoulder strap, including those without handle: With outer surface of sheeting of plastic. The rate of duty will be 18% ad valorem.

The applicable subheading for sample no. 2 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for: Handbags; Whether or not with shoulder strap, including those without handle: With outer surface of textile materials: Other: Of manmade fibers. The rate of duty will be 18.8% ad valorem.

The applicable subheading for sample no. 3 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS(, which provides for: Travel, sports and similar bags; With outer surface of textile materials: Of sheeting of plastic or of textile materials: Other: Of manmade fibers. The rate of duty will be 18.8% ad valorem.

Items numbered 4202.22.8050 and 4202.92.3031 fall within textile category designation 670. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
