RE: The tariff classification of a rain sensor kit from Germany

Dear Mr. Resetar:

In your letter dated March 26, 1999 you requested a tariff classification ruling.

As indicated by the submitted sample, the rain sensor kit, identified as Part #996 612 981 00, consists of a sensor device with attached insulated conductor, and an electric relay. The sensor device is attached to the relay by means of a connector, and the relay connects to the vehicle’s electrical system. In operation, the sensor attaches to the inside of the vehicle’s windshield above the rear-view mirror, and senses the motion of raindrops. Information from this sensor portion is fed to the relay which, in turn, adjusts the speed of the windshield wipers.

The applicable subheading for the rain sensor kit, Part #996 612 981 00 will be 8536.41.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for electrical relays: For a voltage not exceeding 60 V. The rate of duty will be 2.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
