RE: The tariff classification of a CD CARRY CASE from China.

Dear Ms. Leggatt:

In your letter, received at Customs March 22,1999, you requested a tariff classification ruling on behalf GPX Inc., St. Louis, MO.

The sample submitted with your request, no item number, is a CD carrying case, designed to protect, store and/or transport compact disk. The case is approximately 6.5" x 6.5" x 1" in size. The interior contains six doublesided compact holders and the case is secured by means of a zipper. The outer surface is a textile backed embossed PVC.

The applicable subheading for the CD case will be 4202.92.9050 Harmonized Tariff Schedule of the United States (HTS), which provides for cases designed to protect and transport compact disks (CD's), with outer surface of sheeting of plastic. The rate of duty will be 18.8 percent ad valorem.

Currently items classified in subheading 4202.92.90500 are not subject to visa and quota requirements from China.

Your sample is being returned as requested.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
