RE: The tariff classification of hair ornaments from China.

Dear Mr. Lim:

In your letter dated March 13, 1999, on behalf of Bright Choice Inc., you requested a tariff classification ruling.

The submitted samples consist of the following:

1. Sample A is a silver colored metal hair clip with a spring hinge. Attached to the top of the clip is a silver colored metal butterfly whose wings are attached to its body with small springs, allowing the wings to flutter.

2. Sample B is a yellow colored plastic toothed hair clip with a spring hinge. The top and bottom of the clip are molded in the shape of butterflies.

The applicable subheading for Sample A, the metal hair clip, will be 9615.19.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for combs, hair-slides and the like... other: other. The rate of duty will be 11 percent ad valorem.

The applicable subheading for Sample B, the plastic hair clip, will be 9615.11.4000, HTS, which provides for combs, hair-slides and the like: of hard rubber or plastics: other: not set with imitation pearls or imitation gemstones. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
