RE: The tariff classification of an eyelash curler/brush in a pouch from Korea.

Dear Ms. Balice:

In your letter dated March 1, 1999, you requested a tariff classification ruling.

The submitted sample is identified as style #47618. It is an eyelash curler/brush in a plastic pouch. This item consists of a plastic piece with a handle that has a cut-out section to fit over the eyelash. It is designed with a spring in the handle so the individual can hold and release the eyelash. It also includes a small plastic comb with a brush for curling the eyelash on one end and a small pointed mascara brush on the opposite end. These items are used by an individual to create a desired eyelash style. They are packaged in a clear plastic pouch that measures approximately 5-1/2 inches long by approximately 3 inches wide.

The plastic pouch has a zip closure. A small chain is attached with a flower-shaped plastic piece on the end.

The applicable subheading for the plastic eyelash curler will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for...other household articles...of plastics: other, other. The rate of duty will be 3.4 percent ad valorem.

The applicable subheading for the zippered polyvinyl clear pouch will be 4202.92.4500, HTS, which provides for travel sports and similar bags, of outer surface of plastics. The rate of duty will be 20 percent ad valorem.

The applicable subheading for the plastic mascara brush/comb will be 9615.11.3000, HTS, which provides for combs, hair-slides and the like: of hard rubber or plastics: other. The rate of duty will be 28.8 cents per gross plus 4.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
