RE: The tariff classification of “Hair Essentials”from China.

Dear Ms. Kim:

In your letter dated February 1, 1999 you requested a tariff classification ruling.

The submitted sample, “Hair Essentials” is a child’s bag consisting of plastic sheeting, that holds two ponytail holders made from knit man-made fiber fabric and two pair of plastic hair ornaments. The bag is designed with a double handle and a zipper closure.

The applicable subheading for the ponytail holders will be 6117.80.8500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up clothing accessories; knitted or crocheted parts of garments or of clothing accessories: Other Accessories: Other: Headbands, ponytail holders and similar articles.” The rate of duty will be 15% ad valorem.

The applicable subheading for the plastic hair ornaments will be 9615.11.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Combs, hair slides and the like; hairpins, curling grips, hair-curlers and the like, other than those of heading 8516, and parts thereof: Combs, hair-slides and the like: Of hard rubber or plastics: Other: Not set with imitation pearls or imitation gemstones.” The duty rate will be 5.3% ad valorem.

The applicable subheading for the child’s bag will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Trucks,...handbags,...of sheeting of plastics...: Handbags,...including those without a handle: With outer surface of sheeting of plastic or of textile materials: With outer surface of sheeting of plastic.” The rate of duty will be 18% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
