RE: The tariff classification of five Christmas picks.

Dear Ms. Wood:

In your letter dated February 1, 1999, you requested a tariff classification ruling in behalf of your client, Hobby Lobby Stores, Inc., 7707 S.W. 44th Street, Oklahoma City, Oklahoma, 73179 for Christmas picks imported from Hong Kong to be imported through Dallas, Texas.

The items are:

1. XP245 which has polyester leaves, plastic pine branches and natural pine cones

2. XP210 which has polyester leaves, plastic pine branches, natural pine cones, plastic apple and holly berries, as well as a fabric bow and fabric covered foam Christmas present

3. XP232 which has polyester leaves, plastic pine branches, natural pine cone, polyester lower and plastic angel face with wings

4. XP224 which has polyester leaves, plastic pine branches and polyfoam berries

5. XP202 which has polyester leaves and flower petals, and plastic center

All the picks have plastic covered wire stems and are of either snap together construction or glued.

Your samples are being returned under separate cover.

The applicable subheading for the Christmas picks will be 9505.10.2500, 12:49PM Tariff Schedule of the United States (HTS), which provides for AFestive, carnival or other entertainment articles.... Articles for Christmas festivities...Other: Other.@ The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
