RE: The tariff classification of fasteners from China.

Dear Mr. Liberati:

In your letter dated January 20, 1999, you requested a tariff classification ruling on behalf of your client, Spec Hardware Inc., Ivyland, PA.

The subject items are described as a bolt, a spacer and a nut respectively. These fasteners are normally used on car battery terminals. The bolt, which has the characteristics of a screw, and the nut tighten the car battery terminals on the car battery. The spacer insures that the lead terminal is not over tightened. The three items are made of steel.

The applicable subheading for the item that you described as a bolt will be 7318.15.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: machine screws 9.5 mm or more in length and 3.2 mm or more in diameter (not including cap screws). The duty rate will be free.

The applicable subheading for nut will be 7318.16.0085, HTS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: nuts: other: other. The duty rate will be free. The applicable subheading for the spacer will be 7326.90.8585, HTS, which provides for other articles of iron or steel, other. The duty rate will be 2.9% ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
