RE: The tariff classification of a textile boot liner.

Dear Ms. Nelson;

In your letter dated January 20, 1999 you requested a classification ruling on behalf of your client, International Seaway Trading for a textile boot liner from China.

The submitted sample is a textile boot liner, approximately 10 inches high, which you state has an outside layer of non-woven sun bonded polypropelene/polyethylene blend material.

The applicable subheading for this item will be 6406.10.90.40 (HTS), which provides for parts of footwear, uppers and parts thereof, other than stiffeners, other than formed uppers, other, of textile materials other than cotton, of man-made fibers. The rate of duty is 6.8 percent ad valorem.

The boot liner falls within textile category designation 669. Based upon international textile trade agreements, products of China are subject to quota and the requirements of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an international issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding this ruling, contact National Import Specialist, Richard Foley at (212) 466-5890.

Sincerely,

Robert Swierupski
