RE: The tariff classification of heat meltable sealing tape, from Korea.

Dear Mr. Maddox:

In your letter dated January 13, 1999, you requested a classification ruling.

You submitted a small representative sample which will be returned per your request.

The material consists of a heat meltable sealing tape which will be used to make seams waterproof for raincoats. You have not furnished any detailed product specifications other than to say that the product is of a knit polyester fabric coated or laminated on one side with urethane plastic. This tape is 7/8" wide and will be imported in 100 yard long rolls. From observation, the clear polyurethane plastic is in a sufficient amount to be visible to the naked eye and is not over 70 percent by weight of the total weight of the material.

The applicable subheading for the tape will be 5903.20.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered, or laminated, with plastics, with polyurethane, of man-made fibers, not over 70 percent by weight of rubber or plastics. The duty rate will be 8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
