RE: The tariff classification of a lamp-worked glass statuette from China

Dear Mr. Lebowitz:

In your letter dated February 2, 1999, on behalf of your client, Global Sourcing Inc., you requested a tariff classifi- cation ruling. A representative sample of the item and a video tape, depicting the technique used in making the item, were submitted and will be returned to you as requested.

The subject article is a decorative glass statuette measuring approximately three inches in height. The item features a hummingbird with pick-colored wings perched on a stem and a blue-colored flower on a stem. The article is glued to a two and one half inch circular beveled glass mirrored base.

You indicated that each of the main components of the item, i.e., the hummingbird, the flower and the stem, is produced by a glass-worker who takes glass rods of a specific color and softens them over an open flame. When the glass rods have reached the proper softness, the worker shapes the rods by hand over the flame into the desired design.

The applicable subheading for the lamp-worked glass statuette will be 7018.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for statuettes and other ornaments of lamp-worked glass...: other: other. The rate of duty will be 6.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
