RE: The tariff classification of a toiletry bag from Taiwan

Dear Ms. Clarke:

In your letter dated December 21, 1998, you requested a tariff classification ruling. A sample was submitted for our examination.

The submitted sample, style #VS9761 crinkle sheer, lingerie roll-up bag, is a toiletry bag with an outer surface of 89% polyvinyl chloride (PVC) and 11% nylon. It measures approximately 11½ inches x 20½ inches. The outer surface is comprised of PVC with a flap-top closure made of nylon. The bag opens to reveal three zippered compartments. Two are of clear PVC and the third compartment is of non-transparent PVC. It has a hanging hook affixed to the top. Your sample is herein returned.

The applicable subheading for style #VS9761 will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for: Travel, sports and similar bags: With outer surface of sheeting of plastic or of textile materials: Other. The rate of duty will be 20% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
