RE: The tariff classification of glass storage articles from China

Dear Mr. Lencovski:

In your letter dated December 21, 1998, you requested a tariff classification ruling regarding style 76458 which consists of four glass storage articles (a thirteen inch item, a ten inch item and two six inch items) packed for retail sale with a wooden tray.

Each glass storage article has a triangular design and a metal lid. You indicated that the unit value for the thirteen inch storage article is 52 cents, the value of the ten inch item is 43 cents, the value of each of the six inch storage articles is 25 cents and the value of the tray is 47 cents.

The applicable subheading for the glass storage articles packed with a wooden tray will be 7013.39.2000, HTS, which provides for glassware of a kind used for...table (other than drinking glasses) or kitchen purposes other than that of glass-ceramics: other: other: valued not over three dollars each. The rate of duty will be 26.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Jacob Bunin at 212-466-5796.
