RE: The tariff classification of two handbags and one tote bag with outer surfaces of man-made fibers from Korea

Dear Ms. Murphree:

In your letter dated October 13, 1998 you requested a tariff classification ruling.

The items which the Banana Republic intends to import are two hobo style handbags (styles 371960 and 371961) and one similarly styled but larger tote bag (style 371777). All have outer surfaces of polyester fabric, leather shoulder/carry straps attached to the bags by means of metal hardware, and textile fabric linings. Style 371960 “metro comp hobo” measures approximately 12 x 2 1/2 x 10 inches, has a zippered interior side pocket, and is divided into three compartments: two outside compartments secured by magnetic snaps on either side of a center zippered compartment. Style 371961 “metro hobo” measures approximately 13 x 4 1/2 x 11 inches and has a zippered interior pocket and a zippered top closure. Style 371777 “metro carryall” measures approximately 13 x 4 x 13 inches, has a zippered interior side pocket, and is divided into three compartments: two outside compartments secured by magnetic snaps on either side of a center zippered compartment.

The applicable subheading for the two handbags will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, with outer surface of textile materials, other, other, other, of man-made fibers. The rate of duty will be 19 percent ad valorem. The applicable subheading for the tote bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, other, of man-made fibers, other. The rate of duty for this item will also be 19 percent ad valorem. Items 4202.22.8050 and 4202.92.3031 fall within textile category designation 670. Based upon international textile trade agreements, products of Korea are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). The samples are being returned herewtih in accordance with your request.

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
