RE: The tariff classification of a messenger bag, backpack, and dopp kit bag with outer surfaces of sheeting of plastic from the Philippines

Dear Ms. Murphree:

In your letter dated September 30, 1998 you requested a tariff classification ruling.

The items which The Gap, Inc. intends to import are a briefcase type messenger bag (style 162736), a backpack (style 162735), and a utility dopp kit bag (style 162737) having outer surfaces of a fabric-backed polyvinyl chloride sheeting material. The messenger bag (style 162736) has multiple exterior and interior slots and pockets, a flap closure secured by two hook and loop fasteners in addition to two short adjustable strap with snap closures, and an adjustable shoulder strap. The backpack (style 162735) has two backpack straps, a flap closure secured by two short adjustable straps with snaps in addition to a braided draw cord top closure, an interior zippered pocket, and multiple exterior pockets. The utility dopp kit bag (style 162737) is designed to carry toiletries and has a zippered main compartment, multiple interior and exterior pockets, and a short textile webbing strap at one end.

The applicable subheading for the messenger bag will be 4202.12.2035, Harmonized Tariff Schedule of the United States (HTS), which provides for attache cases, briefcases, and similar containers, with outer surface of plastics, other. The rate of duty will be 20 percent ad valorem. The applicable subheading for the backpack and utility dopp kit bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic. The rate of duty for these items will also be 20 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). The samples are being returned herewith in accordance with your request.

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
