RE: The country of origin of an LCD opto-electronic watch.

Dear Mr. Clarke:

In your letter dated April 12, 1994, on behalf of Sunburst Products, Inc., you requested a binding ruling on what the country of origin would be for an opto-electronic (LCD digital) watch.

You state in your letter that the watch to be imported will be assembled in Mainland China, however, the movement (the electronic chip) will be assembled and manufactured in Japan. The movement will be sent to China for assembly into the watch.

For purposes of section 304 of the Tariff Act of 1930, as amended (19 U.S.C. ยง1304), the country of origin of a watch is the same as the country of origin of its movement. Therefore, the country of origin of your watch would be Japan.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
