RE: The tariff classification of a decorative porcelain plate from China.

Dear Mr. Sherman:

In your letter dated October 10, 1995, on behalf of Aztec Frames Ltd., you requested a tariff classification ruling.

The sample submitted is a decorative porcelain coupe-shape plate which measures approximately 8 1/2 inches in diameter. This collector's plate depicts the scene, known as "The Pinpoint Landing" (second of four plates in the series of "Nature's Majesty"), in which the elusive red-tailed hawk is seen in one of its vanishing mountain habitats. It is noted that the back of the plate indicates the wording of "For Decorative Purposes Only - Not For Food Use."

The applicable subheading for the porcelain collector's plate will be 6913.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other ornamental ceramic articles of porcelain. The rate of duty will be free.

It is stated, in regard to the proper country of origin of the merchandise, that the instant plate is manufactured in China and then sent to Canada where a decal of U.S. origin is fired onto the plate. Since the subject article was not substantially transformed into a new and different article of commerce in Canada, the country of origin will remain China.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
