RE: The tariff classification of prepared mustard from Scotland.

Dear Ms. Spektor Bell:

In your letter dated September 1, 1998, you requested a tariff classification ruling.

Two samples were submitted with your letter. One was examined and disposed of. The other is being returned to you, as requested. "Laird's Larder" Spicy Mustard with Scotch Whisky is made from white wine vinegar, brown mustard seeds, Scotch Whisky (3 percent), salt, cinnamon, and pimento. The mustard is put up in hexagonal shaped, glass jars containing 170 grams, net weight.

The applicable subheading for the Spicy Mustard with Scotch Whisky will be 2103.30.4000, HTS, which provides for mustard flour and meal and prepared mustard...prepared mustard. The rate of duty will be 3.3 cents per kilogram.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
