RE: The tariff classification of a candleholder set from Taiwan.

Dear Ms. Balice:

In your letter dated May 8, 1998, you requested a tariff classification ruling.

The sample submitted is a 5-sided star-shape acrylic candleholder (style number 48077), measuring approximately 1 inch in height by 2 1/2 inches across its diameter, which is designed to contain a circular-shape candle, measuring about 1 1/2 inches in diameter, with a metal base. It has been determined that the essential character of the article is imparted by the candleholder.

The applicable subheading for this candleholder set will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings. The rate of duty will be 6.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
