RE: The tariff classification of wrist watch, ball point pen, memo pad and lantern from China.

Dear Ms. Pianko:

In your letter dated March 26, 1998, you requested a tariff classification ruling.

You have submitted a sample presentation box with a fitted zippered container. Included in the fitted zippered container is a wrist watch, ball point pen, memo pad and lantern. The wrist watch is battery operated quartz analog watch in a metal case with a leather strap. The battery operated lantern is approximately 2 inches high and has a key chain attached.

The applicable subheading for the wrist watch will be 9102.11.45, Harmonized Tariff Schedule of the United States (HTS), which provides for wrist watches, battery operated, whether or not incorporating a stop watch facility: with mechanical display only: having no jewels or only one jewel in the movement: other: other. The rate of duty will be 40 cents each plus 8.5 percent ad valorem on the case and 2.8 percent ad valorem on the strap band or bracelet plus 5.3 percent ad valorem on the battery.

The applicable subheading for the ball point pen will be 9608.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for ball point pens. The rate of duty will be 0.8 cent each plus 5.4 percent ad valorem.

The applicable subheading for the memo pad will be 4820.10.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for memorandum pads, letter pads and similar articles, of paper or paperboard. The rate of duty will be 2.4 percent ad valorem.

The applicable subheading for the lantern will be 8513.10.40000, Harmonized Tariff Schedule of the United States (HTS), which provides for portable electric lamps designed to function by their own source of energy. The rate of duty will be 4.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
