RE: The tariff classification of tapping screws from China and Taiwan.

Dear Mr. Johnson:

In your letter dated January 29, 1998, you requested a tariff classification ruling on behalf of your client Compass International Inc., Buena Park, CA.

The subject items are described as parallel threaded, tempered and case hardened, cross recessed flat countersunk head, thread-forming tapping screws made from AISI 1018 or AISI 1022 carbon steel wire. These tapping screws are intended for multiple use, including fastening steel members to one another or to other rigid materials such as plywood, particle board, or gypsum board, in drywall construction and in decking and siding construction. The tapping screws come in the following sizes and lengths:

All of the above listed screws have its greatest outside diameter to be less than 6 mm.

The classification of merchandise under the Harmonized Tariff Schedule of the United States (HTS) is governed by the General Rules of Interpretation (GRI'S). GRI 1, HTS, states in part that "for legal purposes, classification shall be determined according to the terms of the headings and any relative section or chapter notes...". This Rule applies to your products.

The applicable subheading for all of your items will be 7318.14.1060, HTS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: self-tapping screws: having shanks or threads with a diameter of less than 6 mm: other. The duty rate will be 6.2% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
