RE: The tariff classification of a plastic table decoration from China.

Dear Ms. Smith:

In your letter dated December 30, 1997, you requested a tariff classification ruling.

The submitted samples are identified as stock #91038, an assortment of table decorations. The snowmen measure 5-5-1/2 inches in height. These snowmen are made of plastic materials. Your letter of inquiry states that the assortment includes three designs of snowmen. The submitted samples are wearing red and green articles of clothing. One snowman has a sprig of holly in his hat. You further state that this merchandise will be purchased and sold to your customers through your Christmas department as Christmas decorations.

The samples are returned as requested.

The applicable subheading for stock #91038, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for festive...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
