RE: The tariff classification of a girl's shirt from China or Hong Kong

Dear Ms. Malina:

In your letter dated December 12, 1997 you requested a tariff classification ruling.

The submitted sample is a long sleeve shirt made from a woven corduroy fabric which you state is 100% cotton. This shirt has a pointed collar and a full front right over left opening secured by 5 plastic buttons. There is a chest patch pocket on each front and the long sleeves and shirt bottom are hemmed. You have identified this shirt as being for girls and little girls. The style numbers are 52513 and 52514. In a telephone conversation you clarified the size ranges as follows: 52513 is in little girls' sizes S-M-L which are the equivalent of sizes 4 to 6X and 52514 is in sizes S-M-L-XL which are the equivalent of sizes 7-16.

The applicable subheading for the shirt will be 6206.30.3060, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' blouses, shirts and shirt blouses: Of cotton: Other: Other: Girls': Other. The 1998 rate of duty will be 16 percent ad valorem.

This shirt falls within textile category designation 341. Based upon international textile trade agreements, products of China and Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

In accordance with your request your sample(s) will be returned to you under separate cover.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
