RE: The tariff classification of a fabric covered wood trinket box and decorative knit fabric netting from India

Dear Ms. Tuft:

In your letter dated November 17, 1997 you requested a classification ruling.

The ruling was requested on item number 3703, a decorative trinket box, and on item number PT54, decorative knit fabric netting. Samples of the items were submitted.

The trinket box is a four inch square box of wood with a lid. The inside of the box is an open area without compartments and it is lined with textile fabric. The outside of the box is covered with textile fabric and decorated with a beaded gold star.

The decorative netting is an open mesh warp knit fabric stated to be composed of 57.8 percent zari (in this case, a thin strip of metalized yarn) and 42.2 percent polyamide. The material will be imported in 3 yard or 6 yard lengths.

The applicable subheading for the trinket box (item 3703) will be 4420.90.6500, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for jewelry boxes, silverware chests, microscope cases, tool or utensil cases and similar boxes, cases and chests, of wood, lined with textile fabrics. The duty rate will be 0.9 cents per kilogram plus 1.2 percent ad valorem. Effective January 1, 1998, the duty rate will be 0.4 cents per kilogram plus 0.6 percent ad valorem.

The applicable subheading for the decorative knit fabric netting (item PT54) will be 6002.49.0000, HTSUSA, which provides for warp knit fabrics, of other textile material. The duty rate will be 12.8 percent ad valorem. Effective January 1, 1998, the duty rate will be 12.4 percent ad valorem.

The warp knit fabric falls within textile category designation 899. Based upon international textile trade agreements, this material from India is not presently subject to textile restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
