RE: The tariff classification of a men's and women's polyurethane coated jacket from Macau.

Dear Ms. Hui:

In your letter dated November 4, 1997, you requested a classification ruling.

The submitted samples are: style #M81-A018, a men's jacket composed of 100% knit polyester fabric coated with polyrethane which completely obscures the underlying fabric. The garment is waist length, with at full front zippered closure, zippered slash pockets at the hips and zippered pockets on the front yokes. The back bottom half of the jacket is composed of knit mesh fabric. Style #W81-A223 is a women's jacket composed of 100% polyester knit fabric coated with polyurethane which completely obscures the underlying fabric. The garment has a full front zippered closure with slash pockets at the waist and a stand up collar.

The applicable subheading for the mens' jacket style #W81-A018 will be 6113.00.1005, Harmonized Tariff Schedule of the United States (HTS), which provides for Garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907: Having an outer surface impregnated, coated, covered, or laminated with rubber or plastics material which completely obscures the underlying fabric, Coats and jackets: Men's or boys' The duty rate will be 6.5% ad valorem.

The applicable subheading for the women's jacket style #W81-A223 will be 6113.00.1010, Harmonized Tariff Schedule of the United States (HTS), which provides for Garments, made up of knitted or crocheted...: Having an outer surface...underlying fabric, Coats and jackets: Women's or girls'. The duty rate will be 6.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
