RE: The tariff classification of baby's Tub N' Tote articles from Taiwan or China.

Dear Ms. Shimmel:

In your letter dated October 30, 1997, on behalf of your client Kel-Gar Inc., you requested a tariff classification ruling.

The submitted sample is identified as "Tub N' Tote." It includes three items. One non-slip bath mat made of plastic. One three pocket nylon mesh organizer and one nylon mesh drawstring tote.

This plastic bath mat measures 17-1/2 inches by 15 inches and features suction cup extensions that stick to sinks and even textured tubs.

The three pocket nylon mesh organizer is designed to hold shampoo, bath toys and more. The organizer has two suction cups that enables this product to be attachmed to countertops or shower walls.

The nylon drawstring mesh tote is designed to be a travel bag for various personal accessories including the tub accessories.

This sample is returned as requested.

The applicable subheading for the non-slip bath mat will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for...other household articles...of plastics: other, other. The rate of duty will be 3.4 percent ad valorem.

The applicable subheading for the nylon mesh organizer will be 6307.90.9989, HTS, which provides for other made up articles...other, other, other. The rate of duty will be 7 percent ad valorem.

The applicable subheading for the nylon drawstring mesh tote will be 4202.92.3030, HTS, which provides for...travel sport and similar bags, with outer surface of textile materials, of man-made fibers. The rate of duty will be 19.3 percent ad valorem.

The drawstring mesh tote falls within textile category designation 670. Based upon international textile trade agreements, products of Taiwan or China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
