RE: The tariff classification of a tool bag from China.

Dear Mr. Louie:

In your letter dated October 28, 1997, you requested a tariff classification ruling for a tool bag.

The sample submitted, identified as item 70400, is a tool bag manufactured of an exterior surface of embossed Polyvinyl Chloride (PVC) plastic sheeting material. The interior is specially fitted with 11 slots to contain tools and diskettes. The bag has two zippered compartments on either side. One compartment has a zipper on three sides which when in use allows the bag to lay flat to display tools. The bag measures approximately 15 1/2"(W) x 12"(H) with 4" gussets. It is carried by means of two webbed textile carrying handles.

The applicable subheading for Item 70400, the tool bag of embossed PVC plastic, will be 4202.92.9060, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases...; traveling bags..., tool bags and similar containers, with outer surface of sheeting of plastic or of textile materials, other, other, other. The rate of duty will be 19.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
