RE: The tariff classification of Electronic Head Pressure Controllers from Mexico

Dear Mr. Schimpf:

In your letter dated October 27, 1997, you requested a tariff classification ruling. Model 814-10E and 816-10D, are electronic head pressure controllers that are used in air conditioning and refrigeration applications. Through external sensor inputs, the controllers monitor the liquid line temperature and modulate the condenser fan to maintain the required head pressure. The 10E models include an internal 24V AC transformer that powers the controller(s) whereas the 10D models require an external 24V AC power source.

The applicable subheading for the head pressure controllers will be 9032.89.6025, Harmonized Tariff Schedule of the United States (HTS), which provides for other control instruments for air conditioning, refrigeration or heating systems. The general rate of duty will be 3.0 percent ad valorem.

Articles classifiable under subheading 9032.89.6025, which are products of Mexico, are entitled to duty free treatment under the North American Free Trade Agreement (NAFTA) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). It is binding only on the party to whom it is issued and may be relied on only by that party.
