RE: The tariff classification of swim aids and a swim game from Taiwan.

Dear Ms. McCabe:

In your letter dated October 21, 1997, you requested a tariff classification ruling on behalf of Swimways, Corp.

The merchandise consists of two swim training aids and a game for children. One item is described as a Swim Teacher designed to assist young children learning to swim. It is worn over the child's upper torso and provides flotation with two foam sheets contained in nylon compartments.

Another item is identified as Soft Swims, which consists of an inflatable PVC bladder covered by nylon fabric. The Soft Swims are worn around the upper arm and are designed to assist the child to stay afloat while learning how to swim.

The game is called Marco Polo which is essentially a tag game played in a pool. The game materials consist of a vest the child slips over the upper body, six Velcro rings that stick to the vest and one pair of swim goggles.

The applicable subheading for the Marco Polo game will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for "Articles and equipment for general physical exercise, gymnastics, athletics, other sports or outdoor games...: Other: Other." The duty rate will be 4.3 percent ad valorem.

The subheading for the two swim aids, Swim Teacher and Soft Swims, will be 9506.29.0040, HTS, which provides for "Water skis, surf boards, sailboards and other water-sport equipment; parts and accessories thereof: ...Other, Other." The rate of duty will be 1.9 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
