RE: The tariff classification of a glass fiber article from Canada

Dear Mr. Fortier:

In your letter dated October 16, 1997, you requested a tariff classification ruling regarding a glass fiber article. A representative sample of the article was submitted with your ruling request.

The item is an open grid knitted fabric composed of fifty-eight percent fiberglass and twenty-two percent polyester yarn that is coated with PVC by using a dipping process. You indicated that this fabric will be used as a reinforcement for "Soil Stabilization".

The applicable subheading for the glass fiber article will be 7019.90.5050, Harmonized Tariff Schedule of the United States (HTS), which provides for glass fibers (including glass wool) and articles thereof (for example, yarn, woven fabrics): other: other: other. The rate of duty will be 5.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
