RE: The tariff classification of a carrying case from China.

Dear Ms. Lloyd:

In your letter dated October 17, 1997, you requested a classification ruling for a carrying case.

The sample submitted is a carrying case manufactured of man-made textile materials designed to contain a Walkman-type portable radio or portable cassette or CD player. The case measures approximately 6" x 7" and the top is secured by means of a flap with a hook and loop fastener. You have indicated that the case will be imported with a "Bike Tune" portable speaker system (Walkman-type radio, cassette or CD player not included). The case is not designed to contain the speaker system itself, but a Walkman-type radio, cassette or CD player. Whether imported with or without the "speaker system", the case will be classified within HTS 4202.

The applicable subheading for the carrying case of man-made textile materials will be 4202.92.9025, Harmonized Tariff Schedule of the United States (HTS), which provides in part for other bags and container, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 19.3 percent ad valorem.

The carrying case falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
